Sexual violence against women is always a topic of discussion in India. Where in one place there has always been harass punishment for the offence when committed against a women or child by a stranger or family member other than husband but at the same time the non- consensual and forced sexual intercourse by a husband has been provided protection. The recent judgements of Chhattisgarh HC and Mumbai Session Court which held marital rape not be illegal conduct reaffirms the very notion that rape at the hands of husband is legal. While the country claims to protect the dignity and body of the female the law falls short when protecting the wife from sexual violence at the hands of her husband. The absence of laws and the social stigma associated with speaking against rape in a matrimonial relationship is the reason the cases go unheard or unspoken. This research paper indulges in the legality of Marital Rape while also discussing the reasoning of why such non-consensual sexual advances towards a married woman are provided protection under the very law that claims to protect the dignity of a woman.

The World Trade Organisation on Trade Related Aspects of Intellectual Property Rights has made it mandatory for the nations to establish the standards for protection of intellectual properties. The agreement came into force in 1995. The developing countries including India were required to fulfill the obligations mentioned in the TRIPS Agreement by 2000, whereas the developed countries were to by 1996. On the other hand, the time duration for the under developed countries was till 2005. The TRIPS Agreement has indeed suggested a good market for nations like India, Brazil, China, South Africa, among others who have the capacity to manufacture drugs and other pharmaceutical products in their domestic environment. The Agreement also provides certain safeguards. It could definitely make India and other developing countries have a big victory in this sector. The Indian Patents Act was amended under the TRIPS Regime. The amendments were made at three different stages, each stage introducing a new change in the Patents Act. The Authors through this study have tried to analyse the various amendments which were introduced in the TRIPS compliant Indian Patent Act. They have further tried to understand the impact of these amendments in the Indian society, both economically and socially. Finally, the Authors have concluded by saying that indeed the new Patent regime in the country has proved itself to be a growing economic hub for multinational companies.

In India, The Prison System is seen as the place for deterrence, reformation and rehabilitation. At the same time all the above-mentioned theories are put in for a toss when it comes to maintenance of the prisons for human co-habitation. The improper maintenance have led to problems like over-crowding of prisoners, unhygienic living conditions, inadequacy of prison guards and lack of speedy trials. At a crucial time, such as the current spread of pandemic in India, the prisoners and the guards are left with very little safeguarding infrastructures and requisite space. Trials through video-conferencing, hygienic kitchens, effective legal aid and adequate police personnel are some of the recommendations put forth by The Amithava Roy Committee1, that is yet to be approved by the respective States, owing to their inability to bring a standard maintaining procedures in accordance with the committee’s recommendations. At the least, the ratio of adequate guards in proportion to the number of prisoners will mitigate the issues to some extent. For this, the immediate requirement is for the State to actively involve itself in recruiting more guards, so that the prison management becomes efficient and saturated. Prisoners are human beings too, and their basic rights to live in a humane condition is undeniable. On the other hand, the Police personnel who are left to maintain the prisons with very limited infrastructure and manpower also face inhuman treatment because of the State functionaries’ incapacity and inability.
